The Supreme Court of India has allowed automotive retailers&nbsp;across India to sell only 10% of their leftover BS-IV vehicle stock in a span of just 10 days, once the nationwide lockdown is over. Unfortunately, the orders do not apply to Delhi-NCR.&nbsp;&nbsp;

Automakers and, more importantly, automotive retailers across the country got some relief today, as the Supreme Court of India has announced an extension of the upcoming BS-IV vehicle sales deadline. The order comes after the Federation of Automobile Dealers Association (FADA) approached the apex court seeking a deadline extension of the sale and registration of BS-IV vehicles across the country till 31st May 2020. Clearly, the Supreme Court has only partially delivered on the request with some really challenging conditions.

The order allows&nbsp;automotive retailers across&nbsp;the country to sell only 10% of their leftover&nbsp;BS-IV inventory. Further, this extension will only be applicable for just 10 days after the completion&nbsp;of the nationwide lockdown. As of now, the lockdown is set to end on April 14th.&nbsp;The extension is also applicable to&nbsp;all BS-IV vehicles that have&nbsp;been sold so far but have not been registered. But, the Supreme Court has clearly stated that this order will not apply to the Delhi-NCR region. Therefore, as planned, the sale &amp; registration of BS-IV vehicles will stop in Delhi-NCR post 31st March 2020.

While some readers may applaud the Supreme Court's decision, it's worth mentioning that the Indian automotive industry needed much more support and many more last-minute measures in order to fight the ongoing sales slump. While the industry had been reeling under a severe slowdown for the past year, all hopes of recovering the smallest possible margins were quashed&nbsp;when the inventory-clearing initiatives for the month of March were blocked due to the ongoing Coronavirus crisis.&nbsp;&nbsp;&nbsp;

More worryingly, as per FADA, the current inventory of unsold BS-IV vehicles across the country is worth approximately&nbsp;₹6,300 crores, which includes more than 7,00,000 two-wheelers, around 12,000 passenger vehicles, and about 7,000 commercial vehicles.

BS4 vehicle sale deadline: Supreme Court grants extension amid Coronavirus concerns

The order comes after the Federation of Automobile Dealers Association (FADA) approached the apex court seeking a deadline extension on the sale and registration of BS-IV vehicles across the country till 31st May 2020.

In its latest petition, the Centre has requested that diesel-powered defence vehicles, school buses, tractors &amp; private vehicles should be taken out of the NGT's blanket ban on old diesel vehicles in Delhi-NCR.

The central government has recently filed a petition with the Supreme Court of India, which demands that certain specific categories of vehicles should be exempted from the National Green Tribunal's (NGT's) ban on old diesel vehicles, which is currently in effect in Delhi-NCR. To give you a brief overview of the situation, in 2016, the NGT had ordered all Regional Transport Offices (RTOs) of Delhi to de-register all diesel vehicles plying in the city that were aged over 10 years. The decision was taken keeping into consideration Delhi's deteriorating air quality. In January 2017, the central government had challenged the NGT's order in the Supreme Court, but&nbsp;the NGT refused to budge. Thus, the current plea filed by the central government once again challenges the NGT's 2016 order.

This time though, the central government has requested that only diesel-powered defence vehicles, school buses, tractors &amp; private vehicles should be exempted from the ban, stating that the inability of the owners of such vehicles to replace them is hurting their economic condition and directly taking a toll on their livelihoods. This is certainly different reasoning as compared to that given by the central government in its January 2017 challenge petition. At the time, the central government had called the move 'unjust' as all vehicle owners pay a one-time vehicle registration fee for 15 years, at the time of purchase. And therefore, they would suffer a loss if their vehicle is taken away and impounded after 10 years.

Further, the central government also challenged the NGT order on the basis that the Pollution Under Control (PUC) Certificate was already in place to determine if a vehicle was fit/unfit for use. Therefore, an arbitrary order to take all 10-year diesel vehicles off the roads of Delhi-NCR was not needed. However, this reasoning failed to move the NGT. We are yet to see how the Supreme Court reacts to the current petition.
